WAIVER, DISCLAIMER, AND RELEASE OF LIABILITY FORM

NOTE: THIS FORM MUST BE READ AND AGREED UPON BEFORE THE PARTICIPANT IS ALLOWED TO TAKE PART IN ANY DANIKA BRYSHA INC. PROGRAM AND SPECIFICALLY, YOU YEAR 2020.

ASSUMPTION OF RISK

I, the undersigned, wish to participate in “YOU YEAR 2020” hosted by DANIKA BRYSHA INC. I recognize and understand that participating in YOU YEAR 2020 (hereinafter called the ‘PROGRAM’) involves certain risks. Those risks may include, but are not limited to, exposure to content and information relating to health, wellness, and other lifestyle topics. THE PROGRAM is a virtual group primarily for women (though all are welcome) aimed at helping them get clear on what they want in their life as a whole and specifically for the upcoming new year, and developing systems and habits for how to get there. 

Despite these and other risks, and fully understanding such risks, I wish to attend and participate in the PROGRAM and hereby assume the risks of participating in the PROGRAM. I also hereby hold harmless DANIKS BRYSHA INC. and any and all sponsors or lifestyle coaches (“Coaches”), and indemnify them against any or all claims, actions, suits, procedures, costs, expenses (including legal fees and expenses), damages, and liabilities arising out of, connected with, or resulting from my participation in the PROGRAM. I hereby release Danika Brysha Inc, Coaches, and sponsors from any and all such liability, and I understand that this release shall be binding upon my estate, my heirs, my representatives and assigns. I hereby certify to the sponsors that I am in good health and do not suffer from any other ailment which could be exacerbated by any activity involved in the PROGRAM. I further certify that I am 18 years of age or older.

This disclaimer governs your participation in the PROGRAM. By participating in the PROGRAM, you accept this disclaimer in full. If you disagree with any part of this disclaimer, do not participate in the PROGRAM or take part in any affiliated properties, or companies. 

I ACKNOWLEDGE AND AGREE that all information, material, and content found or provided during the PROGRAM is strictly informational. It is general information that may not apply to you as an individual, and it is not intended to serve as a substitute for your own primary care provider, physician, specialist, nurse practitioner, or other applicable medical professional’s recommendations, care or advice. Any and all medical care provided to you in connection with any medical or health-related diagnosis should be administered by your own primary care provider, physician, specialist, nurse practitioner, or other applicable medical professional. 

Before following any particular recommendations, protocols, or suggestions presented by the Releasees, you must consult with your primary care provider, physician, specialist, nurse practitioner, or other applicable medical professional. NO information provided during the PROGRAM should be used to diagnose, treat, prevent or cure any disease or condition under any circumstances. I further acknowledge that I am choosing to participate in this Program by my own free will.

Further, I acknowledge and understand that Danika Brysha, DANIKA BRYSHA INC., (and any Coaches, Sponsors, or anyone else associated with the Program or Program Materials), is not a doctor, medical professional, physician, or registered dietician, and does not assume that role in the PROGRAM. As a curve model with IMG Models, self-care and wellness personality, the Founder and CEO of Model Meals, a healthy meal delivery business, and co-founder of Avocago, DANIKA BRYSHA INC. is not regulated, licensed or certified by any state. 

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMINTY AGREEMENT

In consideration of participant in the PROGRAM, I hereby agree as follows:

TO WAIVE ANY AND ALL CLAIMS that I have, or may in the future have, against DANIKA BRYSHA INC., their directors, officers, employees, agents and representatives (all of whom are hereinafter collectively referred to as “the Releasees”);

TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury or expense that I may suffer, or that my next of kin may suffer as a result of my participation in the Program due to any cause whatsoever; including negligence on the part of the Releasees.

TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for damage to property of, or personal injury to, any third party, resulting from my participation in the PROGRAM.

ADDITIONALLY, I, the undersigned, hereby authorize the Releasees to photograph me, take motion pictures of me, take video footage of me, and/or make electronic sound recordings, or written recordings of me (herein referred to as photographic or electronic reproductions). 

I FURTHER ACKNOWLEDGE that I am choosing to participate in this Program by my own free will and understand that my name, image, and persona will be visible to others in the group and that some materials in the group will be recorded and potentially repurposed for future commercial use by Danika Brysha Inc. I authorize the use of any such photographic or electronic reproductions of me for any purpose, including, but not limited to educational and any other public media (Instagram, Facebook, Twitter, Snapchat) as may be deemed appropriate by the Releasees (I understand that I may be identifiable from such photographic or electronic reproduction).

That this Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators and assigns, in the Program of my death.

BY PURCHASING THIS PLACING THIS ORDER, I AGREE THAT I HAVE READ AND UNDERSTOOD THIS AGREEMENT. I AM AWARE THAT BY PLACING THIS ORDER I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST THE RELEASEES.
